Filing H1 for my wife who is on H4

Hi,

My wife is coming from India on H4 on Feb 2006. I have spoken to a company who can file H1 for her so that she can work in US. As per that company H1 quota for year 2006 opened up in April 2005 and is over now. Hence, the earliest that they can apply for my wife's H1 is April 2006 and it would fall in the 2007 quota.

My Question is that assuming this company files H1 in April 2006 and gets the approval in 2 months time i.e. June 2006, Will she be able to work as soon as Visa Approval comes in (assuming the Tranfer from H4 to H1 is also done), or she has to wait till 2007 as this quota is for year 2007.

Also how much time it takes for H4 to H1 transfer

She can only start working from 1 Oct 2006. Though it is transfer, it will take 2-6 months based on the service center, if you go for premium process just 3 weeks.
