filing GC reques for wife is it possible in my situation ?

Dear friends

1-is it possible for a GC holder (through refugee) to file for a green card for his wife who he married outside of USA After he got his GC???

2-if its possible HOw LONG IT TAKES??

3-During the processing is it possible I live oversieze with my wife after I apply for a re-entry permit

any feedback would be appreciated???

1. No, you can only file for a I-130. When you become a citizen, then file other forms for her.

2. Possible, but approval of the I-130 will take years to come through. It is best if you apply as a citizen.

3. If you mean overseas, then it will create an issue for you because for you to become a US citizens, you need to meet the residency requirement. If I were you, i would block any thought of living overseas, USCIS might question if you are a refugee to the US, what you are doing living in another country.

what do you mean is the I-130 the same as green card , and how many years it takes?

2. 4-5 years. More if she was born in Mexico.
3. Yes*, but you have to return before the permit expires or your own GC will be in jeopardy. You can return and apply for a second permit, but they might give you just 1 year instead of 2.


*as a refugee, if you are going back to the same country you escaped from, even for a visit, you could lose your GC.
