Filing for bankruptcy from India

My student visa expired so I returned to India. I have $10K in credit card debt in the US that I am unable to pay because of medical illness. My only option is to file for bankruptcy. will filing for bankruptcy affect my chances of getting a US visa in future?

How do I file for bankruptcy in US while residing in India?

Please advise. Many thanks.

Don't file bankruptcy. Contact your lender and tell them that you are outside of USA and there is no way you can come back to USA. They will most likely write it off.

VisaNutz,

That makes far more sense than BK. A BK will stay on their credit report for 7 years just like the write-off. But the write-off won't affect their immigration status. Good thinking.

Neither will the bankruptcy. But there are sound reasons not to file otherwise; most loan paperwork asks if you have "EVER" filed for bankruptcy, so you'll need to declare it forever.

Hi,

Thanks for your advice. I am planning to apply for a tourist visa or H1B visa to the US in a couple of months. My credit history is very poor because of the credit card debt that I could not pay. During the interview, will the consulate officer have access to this information, and would I be asked to explain? Can you please advice me on what would be the issues and how best I can present my case? Thanks again.

they dont have access to credit agencies and wont care about that, so no questions will be asked, untill you say a word about it. No worries.
