Hi,
I heard that its possible to file a 7th year H1-B extension even if there is no pending labor application. Is this true?

I also heard that it might technically be true, but it only applies to H1-B2 (i.e. people working closely with Dept. of Defense) but not for H1-B1 (normal H1-B visas).

Please advise.

Thanks,
cartman!

I'm not aware of such. But what do you mean by "... there is no pending labor ..."

Is labor approved?
Is 140 applied?
Is 140 approved?

H1 is for 6 years, and later can only be extended for 7th year only if

LC pending more than 365 days (through ANY employer)
OR
I-140 filed and pending
OR
I-485 filed and pending

***O-1 Visa can be extended byond 6 years without any pending LC
