Hi,
My labor was filied on Jun13th 2003. My current H1 expires on Jan8th 2005.

When soon can i apply for 7th year extension? Can i apply for extension immediately after 365 days are over after applying for my labor,i.e after Jun13th 2004?

Is it true that i can stay for 4 months after my 7th year extension is rejected? If true, then in order to stay more in US i guess, the later i apply for 7th year extension the better and also it is better to apply in regular processing instead of premium processing as the regular processing takes time and we can stay for 4 addtional months after we get rejection letter.

Any information is highly appreciated.
Thanks a lot.

You can apply 4 mos. prior to 8th Jan 2005.

I don' t think there is any rule of staying 4 mos. after rejection. recjection is rejection, unless you appeal.

Thanks a lot alren.
Can you please confirm this.
I guess i just need the receipt to continue working, i dont need to have extension approval to work.

And also what happens, lets say i apply in primum processing 3months prior to my Jan 8th 2005 and i get the approval and after that my labor gets rejected. Can i continue to work entire 7th year or does 7th year extension automatically becomes invalid?

Thanks again alren.

Generally when you file for an extension, you get an automatic extension of 240 days (check with a legal expert). You can keep on working with the rct.

I've heard that you can work for the entire 7th year, but I cannot confirm on that.
