Hello friends,

I have always lived and worked in New Jersey. My company's headquarters is in Seattle. My impression was that my I-140 & I-485 needs to be filed at Vermont Service Center. But my lawyers, without my knowledge, filed the forms in Nebraska Service Center. Can this create problems ?

Thanks for your help in advance.

Rahul

Somebody told me I-140 is applied where employer is located and I-485 is applied where employee is located.

Your lawyer is correct, if it is concurrent filing it has to be filed in BCIS service center that covers the Head office of employer but if your lawyer could have filed only I-140 at NSC then get I-140 approved then you could have filed I-485 in VSC after I-140 approval, I hope yours is concurrent filing and lawyer did file at correct service center

I-485 can be filed where I-140 is pending /approved or I-485 can be filed at service center that covers employee's residence.

Hi,

Thanks for all your replies. My I-140 and I-485 have been concurrently filed with NSC. I guess I am in good shape.

Thanks again,
Rahul
