Filing AC21 myself

Hi. Could anyone help please ? - I have a couple of questions:

1) I'd like to know if I can file AC21 myself. My case is currently at VSC. I was laid off some time ago and finally found a job; I know it's better to deal with the layer and that still a possibility, but ... how much efforts does it take for file on my own? Aside from general idea, I'd appresiate any addresses or phone#, URLs as well; I wonder if somebody've done it before and what's the outcome;

2) What does layer charge for AC21 usually? Please, share your exprerience. If somebody has successfully got a GC as a result of AC21 - please, provide your lawyer contacts (to my email).

You don't have to file anything for using AC21, you might able to use lawyer if they send REF when they reveiw your case.
If you want you can still send employment letter with new pay stub saying you are working in similar kind of job, and for that you might not need lawyer, and for replying REF you don't need to have lawyer from now, if you don't feel comfortable when they issue REF for employment, you can just hire any lawyer at that time. Before leaving old company make sure you have nice relationship with them, because they can revoke I-140, not sure if it create problem of not, but for sure it create more complex situation.

What do you mean by saying: "You don't have to file anything for using AC21"...? Shouldn't I send some kind of notification to INS (or whatewer new name is)?
I believe if I receive a GC approval without RFE and INS still believes I work for my old company - it's risky (think Citizenship interview in 5 years).

On the other hand, say I want to notify INS about job change ( file ) - how do I do that? This is a key question of my post! Thanks!
 
there are two thoughts of train.

Some people belive and interprets under Ac21 you don't have notify INS, becuase unsolicated mail/ information doesn't route correctly and it doesn't serve purpose as compare to REF which has tracking information which take information/ document to your file easly. one other benefit of this if you want to use Ac21 again then you can free to do untill your green card approve and as long as you have job at the time of REF and your I-485 pending for more than 180 days.

Other thought of train think we can send unsolicated information and may it route correctly to your file and won't trigger REF and kept up to date information to INS.

It's your choice to select any option depend of your instict.

MY lawyer also belive in second option, but I don't have specific format letter which we can send to INS to inform Ac21 use.
I would appricate if somebody has any format they used for Ac21 user notification and posted to foram.

AC21 Format

Hi,

This is what my lawyer used when we notified INS about my change of employers:

Letter to INS RE: LIN-XX, Name of applicant, I-485 under AC21

In the body of the letter:
-case background: stated that I started with Company A, with H-1B visa, when Labor certification was approved, what was the job description and the the following duties under that job
-portability: stated that AC21 can be invoked under 2 conditions
-current situation: That I was working for Company B now, with EAD effective until mm/dd/yy, employed with the same or similar job description with the same pay.
-conclusion: Firm is requesting the INS continue processing I-485 under AC21 law, because it has been 180 days since the filing. And that the firm intends to employ me in the same job classification for which the labor certification and I-140 was approved.
-thank you, blah, blah, blah

Attachments included copy of:
-application for alien employment certification
-I-140 receipt
-I-485 receipt
-EAD
-employment letter stating that I still work for them, but addressed to the INS.
