Filing 485 without family

Hi,
My Labour recently got cleared. Unfortunatly my family is in india on vacation for 3 months. I am planning to file for I140 and 485 concurrently for myself at present. Later on after my family returns, I will file for them as well. I came to know that if I file without my family, then INS will keep my 485 file aside and wait for the family to be added. Is it true? Has anybody gone through this process? Please let me know.

It should not be problem. You can do it. But you need to maintain your H1 or L1 status until they apply for I485. Meaning which do not plan to use EAD before they come here.

They wont keep your I-485 aside. Your I-485 will be processed as usual.

How can you even work on EAD when you havent filed your 485 yet? I am sure your file wouldnt be touched unless you filed it concurrently. Moreover, I have seen several cases being lost when they filed seperately.

Why cant you wait for your wife's arrival into US and then file your I140/485 concurrently to avoid confusion either to you and to INS. This 3 month wait would definitely help when filing concurrently.

Want GC Soon :)
