filing 2 I-485s

Has anybody filed 2 I-485s, since my application is stuck with my name check and my wife's name check was cleared in less than a month, so with her own approved 140, maybe she can file her own and get approved quicker, my question is: is that allowed with USCIS or will it complicate things more since she will probably get another A#. Any suggestions will be appreciated.

Hi there,

Dont do this mistake of filing 2 485's at the same time. Doing this is Illegal and if they find it out, your whole process wil be in pretty bad situation.

I may be wrong but as far as I know, I know few people who came from India and they tried doing it, but once they found out, the consequences are oretty bad. Its like somebody trying to get hold of a second passport.

My suggestion. I may be wrong but you shoudl confirm it 10 times before doing this.

Filing 2 485's

Hi,

Its not illegal to file 2 485's. I have filed 2 485's. While filing the 2nd 485 you have to give your A#. The new case will be assigned a diff receipt number with the same A#.

its not illegal but all its gonna do is confuse CIS and cause more delay to your approvals.

CIS is not smart enough to handle this situation and may panic, and I am sure you don't want that.

It's not illegal but not recomended as you will tough time to explain (in case of RFE ) your intension. As GC is for future emplyment , you may not and most of us do not join, you have to show ur intension atleast to join the co at the time of filing and approval.In this case intenson may be questioned?

She should be perfectly fine. There is no law that states thata person
cannot have two I485's in processing simultaneously. Just make sure that
both of you maintain your H1 status until any of the I485 gets approved.

In both the cases, her A# will be unique.. She will face problem only if they
are different.

Whichever the petition gets approved first (I485), the other I140 and the corresponding I485 will get voided.

I have seen a couple of cases like that in which the primary applicant and the spouse treading on other's I485.
