Hello

I am new to the forums and after browsing the posts, had a simple question.

I am a USC filing for my spouse who is on H1B.

I need to file 130, 485 and 864 concurrently - is that correct?

And I need to send it to Chicago LockBox ( i live in TN).

If yu spouse plans on working then file I-765 - Authorization to work. If they have not overstayed the visa and wish to travel, then file I131. Your spouse will also need I693 - Medical Examination...Do not forget G325 - Biographic Information and passport size pictures
All forms will be sent to Chicago.
 
Agreed. The EAD and AP isn't necessary if the H1-B is valid for a significant period of time however.
 
File forms 693 and 325?

Thanks for the replies to my queries. So do we need to file I 693 Medical and 325A at the same time as I 130 and 485 ? (i.e. send all 4 to lock box together).

Also for 765, some of the posts on this forum indicate that we can file 765 online? is that preferred or do we send it along with these (total of 5 forms together)?

Finally, do we need to send drafts separately or together for these forms?

Yes. You need 3 G325A's all together, 2 for the green card applicant and 1 for the sponsor. Each G325A contains 4 duplicates.

You're better off including it in the same envelope as the I-130/I-485.

Drafts? Everything should go in the same envelope. Write seperate checks for each form however. Also don't try to agregate stuff. E.g. If one form asks for 2 photos, and another asks for 2 photos, you need to send 4 photos.

It canbe done at a later time at the request of an "RFE" Request for Evidence" which will delay the processing time down. USCIS will send out a RFE letter informing you to provide the missing documents. I would advise send it with the original submission so as not to delay you getting your green card. It is stressing and LONG waiting as it is. :o
 
ok I have heard different things on the photos question

yes you will need at least 4 photos from immigrant and 1 from sponsor. I sent 6 photos and they still asked for more later. My suggestion would be to send 6 just to be on the safe side.

on the I-864 requires you to have that notarized also be sure and fill that out correctly and make sure you make enough money to qualify. All you need to send is copies of 1040's and w2's going back 3 years.

on the I-693 my service center required that it be sent with the original application. you will have to check with your service center on that one.

Don't forget to make copies of everything and bring extra copies with you to the interview in case they misplace something. The interview might be videotaped just assume that a camera is in the room and act like a loving married couple.

on the ead card
as long as her ead card is valid then you're ok. As soon as you file that paperwork her status is no longer h1 it then becomes "I-485 pending". So the next time you renew the ead be sure and put down the appropriate status.
 
In fact, if you use the newest I-864 form, you do not need to get it notarized.

Do it now. Its required to submit it with the application. If you don't you'll get an RFE, like you would if you miss out any information, and that will hold up your application.

Well your spouse has H-1B, so they can continue to work under that while the GC processes.
 
sorry my mistake

h1 visa people don't need to apply for an ead

also I-864 no longer requires notarization.

however if a situation develops that she has maxed out her h1b extensions and application is still pending then you will have to apply for the ead under the "pending i-485" status
