Hi,

We have never filed I 485 and got today an email that an interview will be scheduled in my home country.
But I am right now in the USA and would therefore like to file I 485.
Is this still possible this far in the process? I have nothing anymore in my home country, no address etc so cannot really go there and wait for the period they need to process everything after the interview

Why did you file the DS-230? Did you misunderstand what it was for?

If your priority date is still current, or you're an immediate relative of a US citizen and therefore don't need to worry about priority dates, you can file the I-485 and tell them you won't attend the consular interview. They will transfer the case to an office in the US where you can be interviewed, but that will delay your interview for about 3-6 months.

Yes I totally miss understood till they sent me a letter that the interview will be scheduled!
I have been doing this all on my own and might not have been that smart ;)
I am an immediate relative, I got married her in the US. So that means I just can file it and to not have to worry.
I have no idea how long usually it takes before an interview gets scheduled, but can than wait a bit longer.

Thanks for you answer, that makes me feel better.

With the I-485 you'll have other forms to file:

  • I-693 medical (schedule the appointment ASAP, it can take a couple weeks to get the results)
  • G-325A (one for you and another for your spouse)
  • I-864
  • Optional, with no fee: I-131 (for Advance Parole) and I-765 (employment authorization) ... however these may be mandatory if your plans involve working in the US or international travel before you get the green card)
  • Copy of the I-130 approval notice
