Filed Adjustment and CP Followup for wife

Hello All

I did my AOS with RD 07/11/2001 ND 08/28/2001 FP 02/11/2002. I am waiting for Approval. In the meantime I rushed to my country and did a register marriage and plan to do Consular processing for my wife. I have NOT so far got the approval (BTW I called the IIO about my case today and they asked me to call in 4 to 6 weeks). If i get the approval do you have any idea how I process for my wife. I was told by my attorney that i gotta wait for my approval notice and thats when i can do cp to my wife. In the mean time I was discouraged by my friends that it will take 3 years for me to bring my wife if I do that. Can anyone help me in this regard. I would appreciate if someone who had done the same(Consular processing follow-up for the wife) could post their experience. Also please give the time lines (months or years) for processing.

I talked to my lawyer some time back regarding this issue. What he told me is as follows:
Lets say, you went to your home country, got married and didn\'t bring her to USA on H4 - assuming all these are happening before your AOS approval. Later, your AOS case is approved and she is still in your home country. In this scenario, you can go for CP-"Follow to Join" process for your wife in your home country. To start CP-"Follow to Join" process for her, your AOS case has to be approved first. That process takes about 6 to 9 months for her to get green-card in your home country and then join you in USA.

If you get married, after your AOS is approved and your wife is in your home country, the situation is totally different. In this case, it will take 3 to 5 years for her to get grren-card and then join you in USA.

So, the important thing is: when do you get married - before or after your AOS approval.

I already got married my AOS is not approved yet. It can be approved anytime now. So you mean to say that it will take 6 to 9 months after i process for my wife. Freedom1971 could you tell me what I kind of documents are required for my wife to Consular Process.

Yes, I heard that it takes 6 to 9 months. You need to talk to your lawyer to find out what kind of documents are required for CP.
