File now or wait, please help!

Hi, Gurus:

Since the company I am working is undergoing layoffs, my company lawyer recommend me to file
regular LC now in order to get a PD, and told me that if later on the company is doing better ( by his definition it means
2 quarters without layoff), they can resume the recruiting effort and convert my regular case into RIR.
My question is: Is this conversion possible?
From what I read from numerous websites, it seems that the conversion is possible only for those who filed
regular before Aug/2001, if so, does that mean if I file regular LC now, I am stuck with regular for the whole process?
If my understanding is correct, then can I ask my company to first withdraw my regular case and file a new RIR? ( I know
one can not have a regular and RIR at the same time).
