Hi, everybody here. This is my case.

My husband is PR. He filed I-130 in August, 2005 when I was in Canada. So when my i-130 was approved by USCIS last November, it was tranferred to NVC for the consular processing. But right now I am working in the U.S.. My visa number is going to be current next month(Nov 1 2009). Could I apply for the adjustment of status to USCIS although my case right now is in NVC? If I can, do I need to do something special to inform USCIS and/or NVC?

I contacted with USCIS and NVC. No one answered my question. I searched online too. Bus still can not find anything. Is anybody here can help me out. I appreciate your reply very much.

If your husband is a LPR you can only do CP,outside country, you can not apply for AOS here. But if your husbad become a USC then is a different story.
Good Luck!

This is nonsense. If the PD becomes current, just file the I-485. USCIS will request the file from NVC.

Sorry I missunderstand...if you are here legally YES you can file I485.
Good Luck!

My situation is very similar to that of the poster who put the query.

I was told that once you file a I-485 along with an I-130 approval copy the I-130 details will be transferred to your local DO before the interview.
