File for AC-21 or wait for RFE

Hi,
I am in the process of using AC-21.
Should I inform INS on my own or should keep quiert and wait for them to issue RFE (which may or may not come).

Please advice.
 
according to some gurus like realcannadian, one should not give uscis info they are not requesting. I would wait for rfe
 
Rules are meant to be followed

1- Any change in status, must be informed to USCIS.
2- Proves good faith intent of GC.
 
ac21 memos say they do not require to inform; they expect you to do it, however ac21 is not something you file. And as any unrequested correspondance if might not make any difference if they want to request an rfe they will, regardless if you sent ac21 paper previously or not.
You are not breaking the law if you dont inform them of job change. And if you do, some people believe they will delay your case even more.
Search on the ac21 forum for post regarding this issue , there are plenty
 
The only people who ever report AC21 documentation to USCIS are guys - who are sure of their employer revoking I140 and are sure of getting the RFE/NOID...

all other folks, usually do not file any AC21 documentation....it's better to wait for USCIS to issue the RFE than to inform oneself.....

I changed jobs in middle of 485 and for sure i know that my old employer WON'T revoke my 140 - so I did not file for AC 21 .

I got my 485 approved in June 07.

According to my lawyer: it adds confusion, so did not file AC21.

I am just suggesting , decide accordingly.
 
My lawyer did file AC21. Job was different in salary terms and state. Lawyer did a pretty good job of mapping old/new job responsibilites. I actually got a phone call from BCIS, thought it was AC21 related questions, they simply validated some information (name, DOB, address) that was it. I felt like AC21 never came into the picture.
 
Doubt

I am seeing many ppl are saying that if we invoke Ac21 we will get RFE for EVL. Whtz if we send EVL along with the AC21 so that there will not be any problems with RFE. Is it correct or not?
 
is it AC21 applies to future job?

Detail:

1. Working for Comapny A ( Eb3 Labor, 140 Approved)..still working
2.Company B Applied Perm Labor and it's approved & 140 also Approved( Eb3 ..> eb2 previous priority date)
3.Company B applied 485 in June ( EAD Approved for me and Wife)

4. Is it possible to invoke AC21 in my case? or Do i need to join company B to take advantage of AC21? if yes..do i need to work for company B atleast 6 months inorder to take advantage of AC21?

Ginnu/TheRealCanadian/Any experts please help...
