Hi,

I hope I am posting this question in the right place.

I am engaged to a legal alien who is currently residing in the US on F1 visa. I am currently on H1 visa. My company is expected to file a Labor Certification petition on my behalf sometimes in December 2005 or Jan 2006. I work in Georgia and will be an EB3 category.

My future spouse is looking to get her residency through me. What is the best way to ensure that my future spose gets her green card at the same time I do?

Do we need to get married before my Labor Certification is filed? Do we need to get married before my Labor Certification is granted? Do we apply together to adjust our status?

Any other comments or info that might be of use to me would be greatly appreciated. Thanks for your help. Good luck in your GC quest.
 
very simply: you need to be married before the Adjustment of status is approved. If you are retrogressed and cannot file AOS even better for you since you have more time then.
