few urgent questions

Hello guys,

we are 5 people together posting this thread, so we have different questions. It would be great if you reply as soon as possible.

1. I have heard that if any person is working from 1st jan to 31st december, he should get minimum $40,000 salary at the time to fill income tax return. Otherwise he will be out of status, is it true?

2. If anybody transfer from h1 to f1, he should not leave the country, otherwise he should do whole f1 stamping process again from beginning, is it ture?

3, If anybody transfer from h1 to f1, after completing study, his h1 will resume and he is not subject to quota, is it true? What happen if he wants to apply new H1 from another company, does he allow to do that?

4, If anybody is on H1, he should get minimum salary approved by gov, if he does not get paystub, he consider as an illegal immigrant and should leave country earliest, is it true?

5, Same situation like question 4, he should not transfer his H1 to another contry without latest 2 paystubs, is it true?

6, I have also heard that to reset h1 cycle, one should leave country for minimum 1 year, is it true?

7, What happen if I leave contry by the end of august and again apply new h1 through another company at 1st april, 2009? Can I allow to do that? I have master degree from US university.

There is no generic figure.. Each job has different prevailing wage.

2. If anybody transfer from h1 to f1, he should not leave the country, otherwise he should do whole f1 stamping process again from beginning, is it ture?
True

True. if new employer needs H1 for you, they can just file H1 petition. No complication.

He is consider in violation of H1 requirement.

Without paystubs, your H1 transfer could be denied because you could not prove you were not violating H1 requirement. i.e. not being on the bench

I have yet heard conclusive answer on this one.

For question #7, won't it be okay to apply for a new H-1 in April 2009? The new visa will have a start date not earlier than October 1, 2009 anyway ... this satisfies the 1 year gap criteria (August 2008 to October 2009).
