Pay as listed on INS site - they recently had to reduce to give credit for the surcharge they collected from us to offset handling of asylee/refugee applications. However this surcharge is mostly likely to be reinstated, but till then pay the lower fees. See 'Filing Fee Schedule" below for more info.

02/22/03: Application/Petition Filings During Transition From INS to BCIS/DHS

Coming Friday, February 28, 2003, the INS will be completely abolished and DHS will take over the immigration business. As we reported earlier, however, people will not notice the change since everything will continue the way the agency has been operated. There will be no interruption or disruption whatsoever and the people will file same papers with the same field offices, no matter whether it is a Service Center or a local District Office. From the information which has been made public, the following is the policy of the new DHS:
Application/Petition Forms: People will continue to use the current INS forms until any change is made.
Filing Fee Payment Check: AILA has been notified that BCIS will accept the check s "made payable to either BCIS or INS." Until further notice, people do not have to worry about filing being rejected because of the wrong agency name they wrote on the filing fee checks.
Filing Fee Schedule: The President signed the Omnibus Spending Bill day before yesterday, but it appears that until the INS publishes the reinstated fee schedules in federal register, people may have to send out checks according to the current reduced fee scheduled and it is not likely that the INS will reject the filing for the reason of wrong filing fee payment. However, there is a chance that the federal register may provide that the agency will collect the differences before they complete the adjudication.

02/26/03: INS Fee Schedule To Be Reinstated to Old Schedule Tomorrow

AILA has reported that the INS will release the Interim Rule on 02/27/03 that will reinstate the filing fees which had been in effect before 01/24/2003.
The new fee will take effect as of the date of publication of the Interim Rule and if it is indeed published tomorrow in the federal register, the new fee will be in effect as of tomorrow, 02/27/03.
The submission of the reinstated fees is required for applications submitted on or after date of publication this Interim Rule, but INS will accept applications or petitions submitted with the fee that was in effect before the publication of this Interim Rule, "if the application or petition is POSTMARKED on or before date of publication of the Interim Rule."
Consequently, if the Interim Rule is published tomorrow and the application/petition is mailed out with the postmark of tomorrow's date, the INS will still accept the filing. Otherwise, people will have to enclose the reinstated fees from tomorrow. Please stay tuned to this web site for the INS release of this Interim Rule tomorrow.
