They responded to my email dated February 5, 2005 on August 13th 2005 And its still pending since March 2003

mani_007, I am in the same boat although I didn't email to FBI until about a month ago. I did however received response to my inquiry from USCIS saying pending "increased security check". You and I probably are among very few people who did code 2 FP in May. I hope our frustration will end soon. Good luck!

I also had code 2 (biometrics) on May 12, 2005, but no news since.

Anyone knows why the "name check" for visa stamp application in US Embassy normally get done within a few days, while the I-485 "name check" takes up to 3-4 years? Are these 2 "name checks" the same animal? IF they are, would it be a good idea just go to home country (with AP), and apply for a visa stamp, and when coming back to the US, the "name check" is cleared???? :confused:

Does any gurus know if "consular processing" does better than AOS in terms of "name check" delay??? :confused:

I believe name check is the same even for consulate processing

I don't think you could have bypassed name check even with consulate processing.
 
My understanding is that

AOS processing

on non-immg visa within 12 months----FBI name check and home country criminal background check thru Consulate

on non-immg visa more than 12 months-----FBI name chank


Consulate processing ------home county criminal background check thru Consulate

Consulate is probably faster than AOS in the States. So what? Your job/wife/property/money/car/motorcycle is here. Do you want to go home waiting on GC? I know I don't. LOL

Persons who is already legally in US can remain in US until the time of interview and medical examination at consular post. Therefore, don't worry about your job/wife/property/money/car/motorcycle :)

No kidding. A consulate can process 485 while an applicant is in the States. Didn't know it worked that way.

Unless the applicant is here for less than 12 months, the FBI name check is in order. There is no way around.
 
I sent email in Feb 2nd week. I Did not receive any email from FBI So far. Hoping they send the Response soon in my case....
