I was told by my lawyer that mine and my wife's I485 was transfer to INS Chicago after INS made mistake last December intending denial our I485.INS admits it is their mistake. We spent 8 months to let our case to re-open. Then
INS-NSC transfered our case to local chicago recently, the reason is FBI's report shown "I was previously convicted of possession of GUN". That is rediculous. I never had a gun in anywhere. I had my fingerprint recorded in police department because there was a conflict with my Neighor downstairs back to four years ago. I played the music aloud in my appartment and cooked breakfast in my kitchen, he came up to knock our door, I opened the door with a knife in my hand. I didn't mean to threat him or hurt him. Because of our unpleasant exchanges before, he called 911, and police came to arrest me. BUT eventually, I was n't charged or convicted. The case was dropped. I had talked this issue with my lawyer since I started to apply GC. He said there shouldn't be a problem. But now INS officer told my lawyer that INS is Ok with knife incident, but FBI's report is GUN possession. I did go my city court to get a record of no criminal conviction. I was very confused and worried. I don't know what I can do, how long will take to be scheduled an interview and how can I prepare the interview?
Is anybody having some advice? any feedback is appreciate!
