FBI Name Check

For those who have got the name check status reply from FBI -- Was the name check ordered by UCIS right after the receipt of the 485 petition or was it ordered at the time of finger printing.

In my case it was neither.

My I485 was filed in Feb'02.
My FP was done in April'02.
My name check was done in Dec'02.

I also think it depends on the time your I485 was filed. It may be different now when the applications don't take years to approve.

How did you know that your Name check has been done on Dec'02. Did you receive from FBI? If so when did you apply and when did you hear back form them?
 
I sent a fax in mid September and got an answer in the begining of Novermber (don't remember the dates). The average wait time is 1.5-2 months. There is a talk though that if the status of the name check is still pending it may take them more 6 months to reply.
 
Yes, someone in this forum said that they got a response saying that they had never received any request from USCIS for a name check for that case.

As my case is also getting delayed inordinately does it make sense for me too to check for the name check??

it does not hurt.. i have seen a few where a long pending name check reply from FBI is given back to USCIS upon the receipt of such mails..on the other hand if you know that name check has not been requested ( red alert ) then you can discuss that to your lawyer / seek help from local congressman / write a letter to USCIS ..

I have seen a posting(s) in this forum saying that people who filed 485 after July/aug 03, the FP1 request would be sent only after their name check is cleared. Assuming that I did not go for name check. But any how you are right and even I am planning to do that.

that is said and published on murthy..folks getting FP1 in and after sept should not worry about name check..but who knows if you fall in a "unlucky batch" left out in open..

Can you send me the link from murthy.com where it says that people who filed I-485 after sept 2003 will receive FP notice only after their name check is done

That is not TRUE..
 
I agree sree1965. Murthy is only saying that USCIS has decided to send FP only when I-485 is ready to adjudicate. It may be with reference to some memo around that time.

Recently we saw many cases approved/REF/Transferd in few weeks after FP1/FP2 exactly depicting what Murthy is telling. But My FP was done 3 and half months ago and not even LUD has changed after that. I faxed/email 2 name check enquiries but no repsonse.
