FBI - Name check cleared !

If everthing was cleared a long time ago. what are you (or BCIS ) waiting for?

Most people know that fingerprint result is valid for 15 months.

I was told on 5/10/2004 by one BCIS information officer at Newark, NJ that security check result expires in 3 months. If this info is correct, your name check clearance of Dec 2002 apparently expired long time ago. I hope the officer gave me wrong information. I know most of them are ignorant, so I always make my own judegment on what they told me.

How do we know, that FBI does both FP check and Name Check?
Has it been documented some where? dSathish, Can u please clarify how u received the information u have mentioned.
Most people when they call FBI are being told that the results were sent the same day. So far u, did they say that ur FP2 results sent the same day and Name check results sent after 2 days?

That's what i (and i guess everyone else ) has been asking ! :)
My company's attorney also contacted my state's congressman and i got a call back from them 2 days later saying that they checked up my file and that everything was a go ! , so it is "just like waiting in the line for you" (exact words from the congressman's office).

I also hope someone can clarify whether the name/security check need to be done for more than once. And whether it expires in 1 (or 3?) month. I vaguely recall to have read it somewhere that the check is done once at the beginning of the case and at least once more at the end.

No, I have yet to get a 2nd FP, however at the time of the inquiy (around mid march) my 1st FP was still valid (almost) as i had it on 12/10/02.

Just ignore the wordings here. As information flows from one source to another, the wordings change by the time it reaches 1oth person. What's in a name ? :p . Since GCtheKey used the word "name check", i used the same one, but otherwise there is only one check that the FBI will do based on the finger prints. Usually it takes any where between 1 day to 1 month, based on their workload or other circumstances.
As for my source, it is the knowledge i have gained in this forum based on earlier postings. I don't remember the thread details. Once in a while some one comes up with some reasearch documents in this forum.
 
What you said is not true.

What is true is that Fingerprint and Name Check are TWO different security checks which are done by different divisions of FBI.

the name check is done by the FBI NATIONAL NAME CHECK PROGRAM unit in Washington DC. If you want to see what this is/how it is done, go to the FBI website and look at the congressional testimony in the FBI press room. It tells you exactly what they do for the name check. the name check is requested by the Immigration Officer, just prior to adjudication. therefore the length of its validity is immaterial as it is the last check done prior to approval.

the FBI does a fingerprint check also. the fingerprint is a separate "application" and its notices are generated separately, and not necessarily at the time of adjudication-- unless the IO finds that due to a service error, your FP has expired-- at the time of adjudication.

this is why [due to a MAJOR computer/service error], thousands of people got unnecessary 3rd FP notices a little while back-- only a few weeks after the 2 nd FP. that was not because of a human error [except for the programmer...]

the FP is valid for 15 months


to be clear, these are 2 entirely separate checks, performed by 2 different units of the FBI, requested at different times.

I made a telephone inquiry about the status of my FBI name check at May 5th. At May 20th I got the call from FBI. The lady told me that my name check was JUST CLEARED :p and that they will inform INS (she used name "INS" instead of "USCIS" just like in IsGCTheKey case). She also excused that it took 11 months to process.

There is one inconsistency that bothers me: according to the information that I received from a congressman inquiry, my name check request was originally submitted to FBI in January 2003. Because of FBI did not answered in 8 months USCIS resubmitted the request in September 2003. So it took either 16 months to process if count from the original submission date, or 8 month if count from the resubmission date. Neither one is 11 month :confused:

I used fax to inqure the result of name check and got email reply after 3 weeks. I was told the name was completed and the result was sent to INS on Mar. 9, 2003.

Question: He didn't mention if the result was cleared, should I concern it?

CIA Name Check

Is there any phone number for CIA name check like FBI does?

The other Security check is CIA name check (i think that this is same as IBAS name check). I think this wil be done when the adjudicator opens your file for adjudication. If your name is not hit, then you are fine, otherwise your file will gather dust while waiting for CIA to get back to INS on your case :( .
The reason for having these two separate checks could be because FBI database contains only national crime data where as CIA database contains international crime/secret data.

I faxed FBI my name check inquiry on 3/5/04 and received its email dated 3/11/04 stating my name check was done on 3/9/04. Before I sent the fax, I talked to a lady in the office of Mr. David M Hardy.

I think your call to FBI triggered the FBI action just as my fax did.

Don't give smile face too soon. As of today I have not received any letter from local office and the information officer still gave me a letter on my 5-10-04 visit in which she hand-wrote that " ... This service is waiting for clearance....".

Even though my wife's name check was cleared on 11/5/03 and passport stamped on 3/4/04, she still has not received any official approval letter from the local office.

So even after your name check is cleared, it is not clear how long your file will sleep there before the officer pick it up and process it.

Did you try to call your local congressman ?

I have called and received a great help from them. If nothing happens diuring the next few weeks I am going to call again and ask them to "nudge" USCIS.

If congressman alternative does not work you can try your state senator.

The one thing is important: USCIS can not longer repeat the old song that our cases are pending because of FBI namecheck.

Another good thing is that we see some understanding and cooperation from the FBI site.

I hope that our torments will end soon...

Question for those they already called or used fax for FBI name check inquiry.

I already called on 05/12/2004 that 202...... number and left my info but no response from FBI, should I go for fax or just wait for another week.

A lady from FBI Name Check office told me it takes 15 to 20 days for FBI to respond to phone or fax inquiry. So you may want to wait till the maximum of 20 days has reached.

FBI Name Check answer machine: 202-324-2399
FBI Name Check fax number: 202-324-3367

Put the following in your fax:
---- A #
---- Full Name
---- Date of Birth
---- your email

I also put my ss#, home phone# and address to be absolutely unique in the whole world.
