FBI Name Check Cleared, Oath Sechaduled. KNOWLEDGE IS POWER, SHARING IS SUCCESS

Hello All;

My Natuarlization trip is close to be over. I was stuck in the name check mania. It was finally cleared and I received the oath letter for January....YES :D

Here is my story
- October 2004: N-400 Application sent
- November 2004: Name Check sent from USCIS to FBI
- December 2004: Fingerprint done and cleared
- Feburary 2005: Interview done(decision can't be made because of background check)
- June 2005: The four month statury period after the interview ended
- July 2005: Filed lawsuit in federal district court (YES, less than a month after the four months ended)
- November 2005: Name check was cleared and results sent to USCIS
- December 2005: Dropped the lawsuit
- December 2005: Received the oath letter for a ceremony sechaduled in January 2006.

I am very thankful to the USCIS team who handled my case. I truely beleive the name check thing is something out of their control and they are just folllowing orders. They have been very professional in dealing with me and my lawyer through out the whole process. I just learned the process from this community and from the pacer service and I followed it. Truely, KNOWLEDGE IS POWER, SHARING IS SUCCESS :)

I can't give any details about my lawsuit and the negotiation process. But One thing I can advise everybody in this community is to hire a lawyer. Don't do it by yourself. For a very simple reason, you are giving the other party the indication that you are cheap and don't have the money to walk the walk. I am very thankful to my lawyer in helping me complete this process.

Does anyone know a good lawyer in Washington DC. I decided also to file a complaint for citizenship delay for a pending name check. My interview was on 07/08/05. Now, it has been more than 120 days. I need a lawyer who has filed similar complaints (and with a reasonable fees). By chance, can someone tell me please how much a lawyer may charge (approximately) for such a case. Thanks

I don't see anything wrong with sharing the details of your case, as everyone here does, it's not a secret. You are taking about sharing knowledge, then share it, you are not sharing anything with us so far, and you even confessed that you got that knowledge from this community!

I remember your case, and i remember you, we used to complain together and suffer together, now that you got the citizenship, let's celebrate together too!

Thanks so much for ur info and congrats. I am in the same boat, inspired by ur story, just wondering where u r because it seems ur interview only took place 4 months after sending ur N-400. I am looking right now for a lawyer in DC.

Congratulation for your success. But, like SONY said, you owe it to the community to share your experience.

Well, you had your success be a sport and help others as well, the way you've been helped.
Nobody wants to know names and exact details and places, so you don't need to compromise the outstanding USCIS team who solved yor case, we totally understand you don't want to jeopardize their job by revealing that contrary to USCIS policies they performed their duties and solved your case :D :D :D
My question for you is: If they were so wonderful, why they didn't ask FBI to expedite your name check before the lawsuit? why was necessary that you spent time and money with the lawyer to sue them in order to get what you're supposed to get anyway? Wonderful people, real heroes :D
If you really appreciate them so much, do them a favour and tell as the story of your experience, maybe after that we will change our way of thinking about USCIS employees!?!

Once again: Knowledge is power, Sharing is success (you said it, and we agree with you) then empower us with your knowledge, and let us have success as well, by sharing your experience.

I have two questions. Does your name has any words related to common muslim names. I read somewhere there are over 40,000 names in the FBI watchlist. My impression is that if there is match with any of the names, then they will take more time to complete the name check.

Does filing case triggered your namecheck pending completed? It still took five more months. What's the point of filing lawsuit then?

- It took five months because: first, it took USCIS almost 2 months to send an expdiate request to the FBI afer the filing of the lawsuit. Second, it took the FBI 2 months to complete my name check because I got a positive hit (meaning they have a file on me :eek: ). It took USCIS another 1 month to review and approve my file.

- Yes, I am from a muslim country with a muslim name. Not very common, but muslim name enough to triger the 20 security agencies to invistigate me :confused:

Steve could be right, however, i am from a muslim country, with a very famous muslim name, though, my name check was cleared within 2 weeks! Yes, only two weeks.

Just wanted to bring that to your attention as a generalization couldn't be ACCURATELY drawn for muslim and/or common name. Who knows, i might be just an exception!

If it's not one is another...you name was cleared in no time but yo got your share of $hit (pardon my french) from a different direction :D like I always said: INS sucks! :D
For Steve_Houston the beautiful USCIS team, needed 2 (TWO) months, AFTER THE FILING OF THE LAWSUIT to ask FBI for expedite his Name Check...I'm wondering how long it was suposed to take without a lawsuit...TWO DECADES?...OR MAYBE TWO CENTURIES???

To Answer your last question; according to a trusted source, an average of 2.5 years. I waited 14 months from the date I applied for my name check to clear with a lawsuit. For me that was a very long pierod of time, and I truely faced hardship with it. My problem was not the waiting time, my problem was are they gonna every approve my case!!!. For them 14 is just a number that is more than 6 by 8!!!!!!!!!!!!!!!!!!!!

Who thought a name cause that much trouble. One has to suffer for other's mistake, though he has nothing to do with it. How long will it last and what else is in the store in future?

Congrats , first of all of your success.

You sued INS and not FBI. You think FBI cares about INS being sued so as to expedite your case, even if they get a expedited request from INS. I think FBI work on their own pace.

regarding a muslim names, I am from a muslim country as well and my parents who had just gotten their oath, got their names check cleared in no time. What I understand is, it is not the name but it is, if your name get a hit then it takes forever otherwise it could be cleared in a day.

One in top of the other, you did the right thing, and you had the guts to do it. I commend you for that.
I didn't have any intention to antagonize you, but your kind words abous USCIS... :confused:
On the other hand is totaly understandable your happiness and the fact that you were so relieved that you could kiss on the forehead your worst enemy at that time. It's human and normal. But for us, who still have to take all the $hit from USCIS...is hard to swallow the story with the kind and beautiful immigration employees...who in fact, 2 months after been sued, decided to do what they were supposed to do anyway!
Anyway, once again, congratulation, you accomplished a big thing in your life :)
