My 485 name checks have been pending for 2.5 years. Wrote to the congressman overseeing the district where I am living. Early this month, the congressman's office told me that they had contacted the Name Check Dept. of FBI for my case. Last Friday I was forwarded the following FBI response from the congressman's office (ABC below is one of the staff from the Congressman Office):

"Dear ABC:

I am responding to your facsimile inquiry received xxx xx, 2006, concerning the name check status of xxx for immigration purposes.

A review of the Federal Bureau of Investigation's (FBI's) Name Check Program database concerning this individual revealed that a request was received from the United States Citizenship and Immigration Services on xxx, 2004, and is currently in a pending status.

The FBI is sensitive to the impact of the delays in processing name check requests. At the same time, the consequence of the FBI's mission on homeland security requires that our name check process be primarily focused on an accurate and thorough result. While an exact date for completion of this review cannot be given, please be assured that the results will be made available to the immigration authorities as quickly as possible.

I trust this information will assist you in responding to your constituent.

Looks like FBI didn't give a shit to the Congressman! Frustrated!

I think - at least your congressman directly contacted FBI - that's a rarity these days....

Give it a month or two - see if anything moves...

I have been trying senator's office to contact FBI - but they are refusing to do so....everytime they contact USCIS and say "WOW - Background check pending" I am out of my wits...

Hi freeskyline,

Have your congressman contact USCIS to expedite your name check.Congreeman direct contact with FBI less likely to be fruitful as FBI is not bound to expedite if not received via the submitting agency i.e.USCIS.

Hope this helps and all the best.

Have you considered filing a WOM lawsuit?

I was 2 EB1 guys who filed lawsuits after just 1.5 year wait...

Congressman cannot help!

I have had my congressman and my senator contact them twice each. Each time FBI says wait another 6 months--6 months wait is nothing for them. I would not feel so bad about it if after 6 months I know it will be done, but after 6 months they casually tell to wait another 6 months. My namecheck has been pending for 2.5 years. I just got another reply from FBI through the senator's office with the usual message from them about why it is important that they take all the time that is needed---unfortunately there is no limit on that "needed time"
