HI! Everybody. I really confused and Want if anyone has experienced like my situation. here is my case: My wife came US in 1999, and she was give asylee status. She sponsered and i was admitted as a refugee under section 207. However, when applied greencard, the NSC informed me that eventhough i was admitted under section of 207 as refugee my status is asylee under section 208. My application is still pending, but that is not my concern. My concern is once I get approval how are they ganno backdate it. are they ganna backdate from the date I as addmitted or from the one year before the approval as they do to the asylees. and keep in mind my case eventhough it is a deravative asylee, my case was proccessed overseas and I came here as legally. if anyone has any information on this, I will highly appreciate it. thanks

I am assuming that your wife was granted asylum under section 208 and then she petitioned for you. When you entered the country the inspector made a mistake and stamped you under section 207. The INS later caught the error. Unfortunately you are an asylee and your green card will be date backed only by one year.
 
Thanks Cadel. You are quite familiar with my situation and you described it correctly. But what is confusing me is I met a man who works with refugees. He helps them with immigration issues, and he told me that He saw many people who are like my case. Even though he said they were asylees when their greencard was approved it back dated from the day they were addmitted. So, My question is did you actually meet or know peopel who are me and whose greedcard was back dated one year before. and again thank you for taking the time to respond to my e-ail. I really appreciated. This is very importand because I am thinking of planing the future. and each case will need different planing.
