FAMILY GC- removal of conditional status

Hi!

I got married to an U.S. Citizen in jan 2007 and got my conditional GC in Mar 2008 which is good till mar 2010. Its a genuine marriage but due to her parent's interference this marriage is about to end. we are not divorced yet but we haven't spoken to each other in 3 months, she is in california and i am in IL, we also bought a house in nov 2008. I am suppose to file the removal of conditional status in dec 2009. Could anyone tell me if my wife is not with me and we are still not divorced, how is it going to effect my GC status.

The intent of marriage was not to get GC. The marriage has been a roller coaster due to my wife's parents interference in our lives.

You can :
1. If you think that your marriage will work out, file for a joint removal of condition,if your wife is willing to sign I-751 within 90 days of your conditional GC expiration.
2. If option 1 is not possible, you need file for a Waiver,saying that you entered the marriage in Good Faith.you need to send all the proofs of your marriage along with two affidavits from people that knows both of you.
But you can only file the waiver once your divorce is finalised.



One suggestion - Try to save your marriage.
