Fake employer

A friend of mine and his spouse got on May 2004 I-140 approval (CSC) from a relative on a fake labor petition (he doesn't work at this place and he won't), this petition was filed for another beneficiary.
On June 2004 they filed I-765 and I-485 (CSC), on August they got EAD (both), and SS numbers.
Does anyone know what's next??, will they get Permanent Residence (GC) without interview??, Can they be in trouble??

migue1967,

It is perfectly legal since Green Card is for future job and not for current job. Your friend needs to join the company once he gets his Green Card otherwise it could be considered as fraud.

I always have this question about future GC and would like to know if anyone has an answer.

GC is clearly for future employment so it's possible for a candidate to receive his/her GC without ever working for the sponsoring company before. However, the company has to intend to hire the candidate indifinately at the time the I485 is being approved.

If my above theory is correct, my questions are:
1) what about I140 RFEs asking for paystubs or W-2? Obviously the candidate has not started working yet thus no paystubs nor W2s.
2) what about I140 RFE asking for EVL? can the employer issue a letter of "intend to hire"?
3) will this case more likely be sent to local interview before I485 approval? Will this candidate pass the interview without having W2, paystubs, but only an intention letter from the sponsoring company.

Why is every one interested in some one else case? The person who initailly asked this question has some interset in that couple?

May be its fraud case, may be its not. Let INS deals with it. I think we should discuss our own cases and mind our own business.

If the person really is very law abiding and has felt "tremendous pain" to know about this "fraud", let him/her inform the INS formely and in detail.
