F4 CSPA rule

Adding on here what I have found from DOS where it seems official policy is that only the first wife is considered the legal wife.

Again, a lawyer would advise best way to move forward on this.

Is there there any way I can remove his first wife who is in the case, as they are separated for long time; my brother and I would like to remove her from the CEAC site, I tried removing and asking me to upload the document, what document should we upload? or what document it required to remove, please advise

I’ve never done this so not sure what to advise. If they are asking for a document as reason to remove from the case probably wanting a divorce decree which it seems they don’t have, I would suggest you contact NVC directly and ask them to remove it rather than do via the website. Last resort, pay the fee and when filling in your brother’s DS260 - where under current circumstances he will have to list his wife if they are not legally divorced - check the “is not immigrating with me” box to end her involvement in the immigration process.
