My father filed for me. He is a permanent resident and i was over 21 which made me F2B. The I-130 was approved with a priority date of DEC 11th 2009.

However i got married on Sep 02 2010 and my wife is a us citizen. She is ready to file for me. On my I-485, i do now know what to write under "Current USCIS Status"

Any ideas?
Thanks

What type of immigration status do you currently hold? F1 or J1 or expired visitor's visa. If you have an expired visa, then you need to write "Expired Visa (F1/J1/B) , whatever you had.

I came on a visitor b2 visa but it has expired since jun 2002 as it says on I -94

So since my dad filled for me and got the i-130 approved, it has no affect on my current expired vistor status?

B2 visa expired is what should be written on your form. Your overstay is automatically forgiven when you are married to a US citizen, so just be truthful and you won't have any problems. You can use the Alien # on your old I-130 petition, which was initially filed by your father. USCIS will have your information automatically in their system, which will also kill your father's I-130 as soon as your green card is approved.

ok Cool thanks. I just got a bit on edge cuz i read that being out of status makes you ineligible to file the 1 485. Just wanted to make sure
