i am in us on f1 visa for doing montessori teaching credential.i am going to india for vacation .during this visit i am planning to marry a guy whose immigration petition filed by a citizen father is pending.can i apply for him to get f2 visa.right now i am doing my cpt which is for 9 months and the school is going to sponser me for h1b visa in 2007.
 
You can file it for him, but there is high chance of denial because of pending immigration petition. However, he can probably get H4 if you are on H1. And here is another fact that you should know. Once he got married, his family base category moves to married son/daughter of US citizen. It will set back his cutoff date by 3 years based on current bulletin.
I don't say don't marry, but just put all the fact on the table and then decide.
