F1 visa - Will I make ir?

Hi Guys,

I saw your forum and you guys have been giving honest advice, I would appreciate your thoughts on my case as well!

So this is my situation:

I have a 3 year degree from India and I have enrolled into a university for a 2nd under grad degree so I can later do MBA(Most US Uni's dont accept 3 yr degree's). I only have to study 1 year to obtain my second degree.

I have 2 brothers in US (1 is green card holder and other on a h1b) and I have a 10 yr multiple visa. I have visited US twice in last 3 years (I was escorting my mother she is scared of heights and she stayed for 5 months in US)

1) Now I am applying for a F1 visa, do you think they might reject my visa fearing a immigration intent? Does it matter that I have a valid visitor visa?

2) Can I apply for h1b directly later if I want to work in US after completing my 1 yr

Thanks,
RSD

I dont think u have any problem, even is a plus to you at least you have traveled to the US and you came back, the traveling history is a plus.Pray and God will guide you through.

I also have a similar problem here but not on traveling history.I am also going for my 2nd bachelors degree for my graduate program. My sole aim is to pursue a masters degree but due to low GPA I was told to undergo some courses in the bachelors way to strengthened my GPA.just for a year. I am 30yrs old with 3yrs of active experience.
What do you think????

A1: You may be rejected due to 214(b). Having family in the US may work against you. However, since you have visited the US thrice and returned on time, that may work for you.
A2: Yes, one can apply for H-1B without ever going to the US for studies.
