F1 Visa Termination

Hi,

I was on F1 visa and had completed two CPTs on that visa.I still had one CPT remaining and I started working on that without letting my school know about it.After two weeks of my joining to the company,I applied through my school for having the CPT process completed. So,I did two weeks of illegal work. But meanwhile,I withdrew a cheque from my employer and unfortunately my school was notified via Red Flag.
When I started working for my employer,he asked me for a paper as proof from my school about the CPT approval. To cater to that,I forged an I-20.My school got to know of my unauthorized employment and my forging the document and they terminated my F1 status and hence withdraw me from the school.I left the country the very same day I was terminated from school. Can anyone let me know if I would be able to apply for an F1 again?
Or an H1 maybe?

It's really up to the Embassy, but your chances are slim because of the document fraud. The good thing is you did not overstay, but there is not automatic bar. Even then, they are going to go that extra mile to make sure the document presented are real and to make sure that you have no intention of remaining in the US afterward.

This is my opinion only and not legal advice. You really should contact an immigration attorney to get some answers.

thanks for the reply.
when they were terminating my record, they informed me they were doing so due to unauthorized employment.Do you think they would have informed USCIS about the forgery. Also, are my chances of H1 also slim?
Could I request my FOIA(Freedon of Information Act) to see where I stand?

They would have noted the reason for the termination in SEVIS for sure. Even though it may not be specific like "alien committed document fraud" but likely more like "alien violated the terms of his/her stay," the embassy will probably want to know the circumstances at the interview.

I am not as familiar with H1, which is dual-intent, allowing the showing on immigrant intent. You might want to post a question in that sub-forum to see the effect of a prior document fraud.

As to FOIA, call and ask them. Here is the link:
