is there anyone can help me with my problem? I just got married to a green card holder. my husband is in the military but it will take him a few more months to get his citizenship. I am curently a F1 student but I may be out of status soon because I am not taking full credit hours. school asked for my residence application receipt but there is no way I can get it now. I don't know what to do . my husband is going deployed very soon. are they going to deport me if im out of status eventhough Im married to a US resident. I want to finish my last year in school But don't know If they allow me. Please, if anyone know anything about this, please help me. Im hopeless..... :(

Hi Baboy,

You need to keep your F1 status in order to maintain your legal stay. Overstay is only forgiven if your spouse is US citizen, which he is not right now and you are the wife of a resident spouse.
You should try your hard to take the full course and maintain your F1 to avoid future complications. I am sure you are stressed about your spouse being deployed, but you should try your best to maintain your status so that when he becomes a citizen, he can apply for your GC. I am giving this advice assuming you have not applied for AOS yet.

Or have you already filed for your AOS?

Even if you fall out of status, you can apply for AOS once your husband becomes a US citizen. Just don't leave the country until you have AP or GC in your hand. Please ensure that you are eligible to use an AP, even if issued one!!!
