F1 to H4; OPT expiring... URGENT

All,

My wife's F1 - OPT is expiring Dec 22 2004. She has applied for H4-dependent visa on Sep 21 2004 based on my H1 approval . They say it will take 100-150 days for the H4 approval.

My question is: After her OPT expires (Dec 22 2004) is she out of status and illegal in US ? Or is she fine since her H4 application is in processing ? :confused:

I have heard about the 2 month grace period after OPT. But, is that automatically applied to everyone, or do we need to inform someone/fill some form for extension of legal status to 2 more months. :confused:

Since your spouse H4 is pending, she is not out of status until her H4 get approved.
