F1 to H1

Hey guys I have an intersting question. Iam planning to enroll in Ph.D program in spring 2007. I have completed my Masters in US and Iam on OPT right now. I just wanted to know if my employer can file for my H1 for 2008 quota even though Iam enrolled in college. Please if anybody has any sort of answer to it please reply.

If you qualify for a Job in H1 with your MS degree, your new employer can

file 2007 quota h1 visa from April 2006

or


2008 quota h1 visa from April 2007.
