F1 to H1 Urgent

I would suggest start the process tommorow....as per the official USCIS web site http://uscis.gov/graphics/publicaffairs/statements/04FirstQtrH1B.pdf
by end of dec 2003 they were done with 43,500 ( that is 14500 per month) and at the same rate..they will be done with close to 58000 by end of Jan '04. All that they will be left with is 6000 plus..and I am sure after they released the above info....many people would have applied to make sure they get one out of the remaining 6000 plus.
Please start of ASAP because you can not get an extension on OPT if you have already used 12 months on it. You either need OPT or H1 to work after june.

What would be the Legal status of the person during the Wait period uptil the visa is approved/rejeceted after Oct 2004 when the new quota opens? Will the person be considered out of status after the OPT expiration plus the 60 grace period days? IF the person is not out of status during the wait period, then what is his Status - F1/OPT or H1 or something else? If somebody who has an expertise on such cases can contribute with an answer, it would be appreciated by all people who would be in this situation.
