F1 to H1 - risk of denial by US consulate in Canada

I came here on F1 and recently transferred to H1B. I have the new I94 from INS. On my lawyer\'s advice I am planning to travel to Canada to get the H1B stamped on my passport. My H1b was granted on the strength of a NOn-US degree and some 5 years of non-US work experience. Statistically speaking what are the chances of the visa application being denied by the Canadian consulate ? ( I am worried they would ask me to go to a consulate in the home country and apply there).

Non US degree is always a risk...

And there have been umpteen number of denials based on this. But your F1 status gives a hope. It won\'t hurt to try , since you are allowed to come back in valid h1 status even if the stamping is denied, from canada within 30 days.

If your degree supports your job needs, then there should not be any problem.
if your degree is different from ur job then there is fat chance visa will be denied.
Otherwise there should not be any problem.

If you had a H1 stamp already on ur passport, as long as you work in the similar
field there should not be any problem.

Always check with your lawyer before you make a decision.

Non US degree...

US consulates in Canada are really picky about educational evaluation. Even educational evaluation letters are no help. For H1 all you need is a bachelor\'s degree. It is funny how the visa officers determine relevance of degree when the industry does not care (Most of my managers have been just High school diploma holders!!).
Anyways, because of foulplay at consulates in asia generally about false degrees etc. US consulates in canada do not want to take the risk of accepting asian degrees. (My earlier statement of non-us degrees was a little sweeping, sorry). This is a practice and not some theoritical insight or a memo by somebody.
After April 1, it is a big risk for OPTs to go to canada to get the multiple entry H1.
