F1 to Green Card

Hey..

First and foremost .. hats off to the makers of this wonderful portal .. you guys are doing a gr8 job .. keep up the good work .. god bless u guys ..

I am on F1 VISA in the US.. my fiance is a US Permanent Resident (awaiting the physical card) .. We will be getting married b4 we graduate i.e. b4 my VISA expires ... now here's what I wanna ask:

1) Will I be able to travel to and from India while my application is processed?

2) Will I be legally authorized to work in the US while my application is processed, I almost have a job offer?

3) Am I still elligible for Optional Practical Training (OPT), available for me through the F1 status ..

4) How mush time will it take for my Permanent Resident application to get through, if not the green card by when can I say that I have the PR status?

5) When do u recommend is the best time to file my application?

Any comments and suggestions will be really appreciated ...
 
She is married to permanent resident not US citizen. I afriad it is not that easy. As a spouse of LPR, it takes a long time (5 years and up) to get your GC. The best is to for him to get his citizenship ASAP.

Is your husband planning to get his citizenship? When will he be eligible to apply?

At this point, you can only file I-130. Once the I-130 is filed, you will not be able to return to US if you travel outside US. But, keep your F1 and OPT going separately is fine. Hopefully, you can get your H1-B through the OPT process.

Anyone else has similar experience, please share.

Your I-130 is for immigration purposes only, and has no immediate benefits for you for the next 5-6 years. You will most likely not get any non-immigrant visa once you leave the US, since you are married to an permanent resident, I-130 is filed for you and thereby you demostrated immigrant intent.

2) Will I be legally authorized to work in the US while my application is processed, I almost have a job offer?

No, you will not be authorized to work just because I-130 is filed on your behalf. You will have to wait for 5-6 years until you can apply for adjustment of status (when a visa number is available to you, or when your spouse becomes a US citizen, whichever comes first) and work permit. if you have a job offer, try to get the employer to get you H1B visa. You can work for a year on your OPT.

3) Am I still elligible for Optional Practical Training (OPT), available for me through the F1 status ..

YEs. DO apply for it before you graduate. Then, try to go to another school after OPT to maintain your F-1 status, or try to get your H1B.


4) How mush time will it take for my Permanent Resident application to get through, if not the green card by when can I say that I have the PR status?

It will take about 5-6 years for you to get an immigrant visa number. Then, if you are still in the US in legal status, you can apply for adjustment of status (AOS) to that of a permanent resident. Then, depending on where you reside in the States, it will take anywhere from 3 months to 3 years to get your GC. You will be eligible for a work permit when you can apply for AOS.

5) When do u recommend is the best time to file my application?

You can file it now or you can wait till your spouse becomes a citizen.
