F1 to EB-3

Hi there, I was an employee in one company since last year and my job got terminated on april because my OPT expired, the company has agreed to apply H1B for me but they're too late to apply it for me, therefore, I have to continue my study toward my master degree.

My question is, instead of waiting for next year for H1B, my employer might want to apply green card for me under EB-3, but the first step is to get Labor Certificate, can I start working after I get the labor certificate? if not, when can I start working? after my I-140 petition is approved? which way is the fastest for me so I can start working again? to apply for h1b next year and start working on october 2007 or applying green card under EB-3?

Other question, what is considered one full academic year by USCIS? is it counted by how many months you spend in school or by credit taken?

Applying labor certification or I 140 will not give any status in US to work. TO apply LC or I 140 should not be present in US at all. To work now you need an H1.

You can work for the company which sponser you with out H1, when you get I 485 approved or get work authorization while I 485 is under process.
