F1 TERMINATED-MORE THAN 5MONTHS _Just aware of it. Advice please

Hi:
I need a very quick advce.. I am out of satus with out my mistake. i am a ph.D student enrolled for same since June 2004. I continued my studies from masters at same school. Today The international office calls me and tell me that i am out of status. And the reason I get is " There is system interaction error" The School SEVIS database system did not communicate well with the USCIS database, result of which , USCIS system shows that my status is terminated since June 1 2004.
My question is
1. Is such thing possible. that as school updates the system but will not be reflected in USCIS system

2. Most importantly, I was reading about the conditions on which The reinstatement is alloed is that i need to apply within 5 months of the termination. Now its way past 5 months for me and I was notified just today!! What r my chances about the approval of the application if I apply.

3. I need to pay $195 for re instatement and loose my oncampus work till I get the new I-20. Even if this happenned with out my knowledge /Mistake, There wont be any help provided by any one? I loose my monthly income too and I support myself?

4. I am enrolled in classes now and would like to continue the same. Hopefully that doesnt hurt??

Please let me know if any body has faced similar situation and any advice regarding the same would be of great help.

First and formost i completely sympathise with you.I have been in a similar situation if not the same.I understand what it feels like.

From my experience, whosever mistake it might be, we are to pay the price.I know it sounds blunt but thats how it is.The SEVIS system has too many loop holes.And the International Student Office in most of the universities just add to the pain.

You can appeal to the International Office Sevis representative to put in a special request, i think that they have the authority to set the status to pending from expired.

Apply for reinstatement as soon as possible.Most of these cases are resolved under the discretion of the USCIS Schools Officer for your area.Right him/her a detailed letter explaining your situation.Shelling out $195 is inevitable, so just take it in your stride.

This whole issue will fortunately not effect your enrollement in classes.And yes, you will not be able to work on campus until you get your new I-20, will not be eligible for any kind of tution fee waiver.And believe me no one will take resposibility for their mistake and just blame on the system.All of this is my personal experience.

So, the best course of action is just go ahead and apply for reinstatement and if that fails then apply for the program again as if you are seeking readmission and get a new I-20 issued.I am sure all the courses can be transferred.

I hope this helps.It is so frustrating to see us suffer because of no fault of ours.

Thanks for the message. Sorry to hear that you were in same situation. Do u have any idea how long it would take after I apply for reinstatement? School says 4-6 weeks. I applied about 10 days back and school did not hear back anything from INS. Up to your knowledge do u know if there is any way to expediate the process? I got employment opportunities and should start working ASAP, or atleast change the VISA status. And it looks like I cannot change the VISA status to H1B until I am clear from this situation.

it took 3 weeks for me.but generally it takes 4-6 weeks.there is no way to expediate the process.by employment do u mean full time employment.is it that you are not able to apply for OPT without the i-20?

A somewhat similar situation

Im also in a fix primarily because of negligence on the part of my International Student Office. I was admitted to my program (MS) for Fall 2004 semester but my visa processing got delayed so I contacted my department and deferred my admission to the Winter 2005 session. The office for International Students didnt update this change in the system(even though I had emailed them about it), and my records were cancelled because I did not turn up for the Fall quarter. So as a result, I found myself out of status the very first day I was in USA !...fortunately I didnt have to apply for reinstatement but something called a data fix...where your SEVIS records are fixed by the INS. this request has been pending for the last four months and there is no news. the international student office refuses to help me and I cant work on campus (but still Im elegible for the tution waiver). I dont knwo what to do...Im supporting myself and its getting more and more difficult.
anyone got any info, please let me know.
