Hi,

I've been studying in the US for 7 years. I'm F1 student and my wife is the US citizen. We had AOS interview last month (July 2011). The interview went well, the officer didn't approve our case at the time. He took off my I94 and told me to wait for any notices and/or a green card in mail. I've been waiting and checking online case status since then but there's no movement on it. Luckily for me I've just start my job(with EAD)and it's a full time job so I need to take and stop going to school. Would it be okay for me to do so since my case hasn't got approved and still pending? Will I be out of status if I quit the school before the approval? Am I gonna be in trouble? Anyone who know, please give me an advice. It would be really appreciate.

Thank you,
:)

Yes its okay to stop school. You will not be out of status, your have a petition with USCIS. You are not gonna be in trouble.

Relax.

Once you properly file for AOS you can stop attending school, provided that you've already attended long enough to show that you're a bona fide student rather than somebody using the F1 visa as a farce to immigrate. You've been studying long enough for that to not be a concern.

Once your GC is approved, notify the school of your GC so you'll get removed from SEVIS monitoring.
