Hi
I am currently holding US B2 visitor Visa. My husband is on F1 in US. I have 2 kids and both have visitor visa. I went to NewDelhi US embassy for converting
my B2 to F1 visa and for my kids from B2 to F2 visa.

I have enough Liquid cash and immovable assets.I have sponsored myself and my husband also have sponsored himself. My husband has 6yrs of experiance and I have 4 yrs of experiance in India. Consular rejected my F1 visa because he informed how husband and wife can become self sponsor. Though we have more than enough funds.

My questions are here:

1) Can I appear again and this time I show my parents sponsoring me
OR
2) I got to US on my present B2 Visa. My husband CPT is going to start soon. And after staying 60 days in US, I should apply for F2 visa.

Please help me in this regard that whay will be safe direction for me

1. Yes you can try again after 6 month but with a new I-20

2. Are u presently in US? or have u used ur B2 visa to enter US? if yes then u can change ur status to F2 if only your husband is holding a valid F& visa and is registered in a college or university;

F1 Visa rejected

Thanks for answersing in my qurey. Right now, I am in India and my husband holds a valid F1 visa. But we also went to US on visitor visa and had changed his status from B2 to F1. I am confussed that which option will be good and best for me :

1) Wait for sometime and go to embassy with new I20
or

2) Enter US on visitor visa. Stay their for 60-90days and then apply for change of status to F2. My husaband CPT is going to start in a month and we can show that his pay stubs also.

Please suggest what can be best option and safe option for me. Though I know nothing can be said with full cetainity but I just want to know which has more probabilty of success.

Thanks once again for your reply

I can not decide for you but let me tell you the fact surrounding your case:

1. It is the best idea to Wait for sometime and go to embassy with new I-20

2 this is because the immigration officials in the US unfortunately have access to your F1application records which means that you could not get the visa in your home country that is why you came there.
But with the marriage certificate and your husband's valid I-20 I think you can change you status in the US to F2 only
But be careful you need to get 5 or 6 months at the Port of entry before you can apply for change of status in 90 days, else if they delay in replying to your application you will be out of status which will nulify your present B1B2 visa.
