F1 , outside 20hrs but got 1099

this is my status:

I am an indian and on F1.

I was working 20 hrs for a univ library and then was offered a research position with a prof in the univ. NOw the prof knew i was working for 20 hrs in the library and also doing research for him . He paid me $450 for that by check. I did this for 4 months Mar-July totalling to 1800 and then quit the group but continued to work for the library till Dec '06 . I have earned a total of 9844.06 . The library has issued me an W-2 for this .

Now outta nowhere this prof is telling me that his company paid me and not him and that he was not "aware" that iw as working outside my 20 hs/week limit when he knew it all. There are 5 of us who r stuck liek this . he has issued a 1099 for each of us .

we dont know wat to do coz he has cheated us now .

I guess we wont get into trouble now for filing with the IRS but will we have troube when we wanan change to H-1 or permannet residency
 
who is listed as the issuer on 1099? the university or some off-campus company?

P.S. the professor is not obligated to know how much you are working. You chose to work more than allowed, it was your decision, he didn't make you.
 
the off cmapus company is listed as the issuer ... I know he is not obligated ot know ... but i told him and he told me it was off the books so i worked ....

anywyas .. the 1099 says that it can also come as an award...

shoudl i file it ??

should i file a schedule C ??

Now do i have to leave the US after filing or is it enuf if i had left like a month ago and come back like 2 weeks back .
 
after filing taxes or for H1? as long as you leave and reenter after you were engaged in that job, it'll be sufficient.

This leave-and-reentry option: is that valid if you travel outside on your existing I-20?
Don't you have to get a fresh ("initial") I-20 for that option to work?
 
i meant after filing for taxes.... i have gone to india and back after i was engaged in that job also to canada when i was engagaed in the job
 
I think you'll be just fine. When I got "new" I-20s for the same program, they looked absolutely identical to the previous ones except for the expiration date.
