F1-OPT-PR Issue

Hi,

I think I have a uique situation and any suggestion is welcome.

My wife is currently on OPT which expires 5/2004. Her F1 is valid until August 2005. I have filed her I-130 (Green Card) based on my GC in May of 2001. Her current employer will file for a H1B in April. My questions are:

1. Does she need to get a new I-20/admission from 6/2004 to 9/2004?
2. Is there a grace period after OPT expires?
3. Is it risky to go to India with the expected H1, considering that it needs to be stamped for multiple entry and that there is an immigration petition pending on her behalf.

+++++++++++++Yes, unless she wants to travel out for an H-1 visa. This question has been answered many times.

2. Is there a grace period after OPT expires?
3. Is it risky to go to India with the expected H1, considering that it needs to be stamped for multiple entry and that there is an immigration petition pending on her behalf.

+++++++++++++++++++++No problem for H-1 visa.

This forum is fighting for 'V-Visa extension" for spouses of Greencard holders. recently a bill HR3701 has been introducen in house to address this issue.
We need some volunteers.
