F1-OPT-H1 Issue

Hello Experts,
I browsed all the forums but could not find information to our situation, can you please help.

My wife finished her Masters in May 2008. She had applied for OPT last year and the OPT validity period is from Oct 1st 2007 to Sep 30th 2008.

She joined a consultancy who applied for her H1 on April 1st.
When the ruling for OPT extension came out on April 3rd, which enabled OPT holders for a 17 month extension, she wanted to do that instead of going with the H1. So he requested her attorneys to cancel the H1 and apply for OPT extension.

What happened is that the the attorney sent the cancellation request after the H1 was approved. They did not communicate with us that the H1 was approved. We only checked the online case status yesterday that said that the I-129 form has been approved.

Every time I check with the HR, she came back and said we sent the cancellation request and are waiting to hear from them. We were never told about the approval going through.

I want to know what can we do now so that she can get her extension or at least have the H1, so that she has a valid visa status in the country.

Were you able to find a solution. my sister has gotten into a very similar situation now. And i came across your post. Her consultant applied for her H1 and it is approved now and now they fired her. She has an engineering degree and if not for her H1 she could have applied for OPT extension. Can she now go back and apply for her OPT extension? Pls advice.
