F1-H1B big list of RFE

Hi,

I just applied for tranfer from F1 to H1B on premium processing through a consulting company. I am not sure if the company submitted all the documents correctly, we got a big list of RFE for the following...
  1. Detailed Job Description
  2. Software Consulting Contract/Agreement
  3. Company profile
  4. Federal Income Taxes
  5. Form DE-6, Quarterly Wage Report
  6. List of all Employees
  7. Photographs of the Business Premises
  8. Business Licenses
  9. Lease Agreement
  10. Floor Plan

    I am afraid that my small consulting firm may or may not have all the required documents. I would like to know if anyone had such a similar experience. We filed for the application on Preimum processing Dec 24. I am very much worried... please advise...

List of RFE

My wife who was changing over from F1 to H1B had a large list of RFEs. Though she was not asked for photographs of the premises, lease, floor plan, quarterly wage report. She was asked to show how her degree related to the job and qualifications of other people in a similar capacity in the company.

I suggest working through this systematically as we did. Answer all RFEs to the best of your ability. Being in a small company has no bearing on the decision to grant an H1. As was the case with my wife who works in a company with 8 people.

Thanks a lot for your reply. I am working with my consulting company to provide all the required documents. It is great to know that your wife got a H1 thru a small consulting company.

Gosh... it is so tensed right now. I hope everything works out fine....

  1. Detailed Job Description poorly prepared by the company or lawyer
  2. Software Consulting Contract/Agreement this as serious impact on your h1 approval. you and your employer should work this out very smartly
  3. Company profile just born company will not be able to show "ability to pay" for you
  4. Federal Income Taxes proof for the above
  5. Form DE-6, Quarterly Wage Report same as above
  6. List of all Employees if you are the first employee its very hard to prove the ability to pay clause unless your employer invested and show the bank statement of good amount
  7. Photographs of the Business Premises eventhough it is not illegal to run a business from home, it gives a picture of your employers ability to pay. if they cannot afford to pay for the office space then how are they going to pay you. you should think twice before joing these companies even if your h1 is approved
  8. Business Licenses uncommon rfe. usually for small companies they use send all the articles or incorporation, tax returns and bank statement along with your h1 documents.
  9. Lease Agreement you mean office space lease ?
  10. Floor Plan this very uncommon and improper. not sure how uscis is going judge your employer seeing a floor plan

Need help

My wife is in the same boat. She is on F1-OPT currently and we need to talk to her employer to see if they can file an H1B for her. In the worst case, how much time does file subimssion to H1 approval process take, if we do premier processing? She works for a large entertainment compnay
 
She works for a large entertainment company
----- if she is not in IT and in entertainment company then she can also get O-1 visa that has no 6 year limit like H1, need to know about her qualifications or work done in entertainment field if she qualifies for O-1 visa. Or file H1B, employer or lawyer can get LCA from DOL in 2 days and can prepare the H1b filing papers in 1 day and file with premium processing as the H1B cap may reach early. O-1 Visa status has NO Cap like H1B.
