F1 cancelled by Univeristy by error - Please Help!!

Hi,

My friends wife is here on a F1 VISA and she's been attending school for over a year. Just a couple of days ago they were notified with some shocking news by the school that she has been out of status for the past 3 months..

Digging into this issue a little deeper, he found out that an official from their International Students Office had erroneously deleted her record from the INS SEVIS database which led to the cancellation of her VISA. As luck may have it, this offical passed away a month later and his replacement realised this issue and notified my friends wife..

The University has accepted full responsibility for this issue but have said that there is no way for them to recitify their mistake thru SEVIS. So the onus is on my friend and his wife to straighten this out with INS..

I was wondering if anybody has had any similar experiences. My friend lives in the Greater Boston Area and we are looking for a good lawyer..

Please help.. As you can imagine we are getting quite worried and panicky.

I am so sorry for the problem that happened to your friend's wife. Actually, the same problem happened to me. DSO had issued me a new I-20 when I graduated and moved up to the higher level for post graduate degree instead of upgrading my old I-20. Even if the new I-20 in SEVIS had been created from the old one and has all my port of entry information and etc., it made me in trouble.

The school has filed H-1B petition for me since October 4th, 2004 using premium processing and INS have not yet processed it. I was informed that my application floating between agencies to check my background or any felony. The last time I was told "the best solution is to hire an attorney to follow up your case before it is out of your hand." I guess she needs to contact an attorney as soon as she can and doesn't let time to go away since I did that mistake. And, now I can not do any thing for my H-1B and I am about to lose my status, too.

I hope she can seek help from the right channel and fix this problem.

apply for reinstatement with your International Center's assistance. They need to write a statement that falling out of status was through no fault of yours, and it's their mistake.
 
Same Case...but in a different way

Hi there,

Even i am facing the same problem now. the university people got the wrong program end date on my I-20. actually it should be typed as May 2006, but it was typed as MAy 2005. the surpring part is here.

when i went to them as told about this problem long back in Feb 2004[ i got my I20 in this month from the trasfered univ] they realised the mistake done and they printed in the remarks section of the I20 as :"the program end date has been typed wrongly, the correct program end date is may 2006". they even told me that they updated my SEVIS record. but they never updated it.

to my fate i am getting graduted this semester. they are asking me to wait until may 2006, so that i can apply for my reinstatement and apply for my OPT in MAy 2006. so do i really need to undergo all these because of the mistake done by the university people. do i really need to waste 5-6 months of my time and money?.

im really depressed and kindly help me out with the situation. the university people are not hleping me out in any way. they just gave me this option and they are not clear about this one too. they are keep on waiting me all these days . is there any other option available ? kindly suggest me about the situation.
