F-1 to H1B no degree cert yet

Hi!,

I was on F1 visa for a bachelor's degree. Was supposed to graduate in May but did not graduate due to one course. I have now completed all course requirement for BACHELOR's degree and school certified my as August gradute. I am on OPT and working with a company who wants to file my H1b but their lawyer said i technically don't graduate until i have degree certificate in hand and he scan't use the letter(s) provided from my school's DSO and my academic advisor certifying complted course work towards Bachelor's degree. DSO even updated SEVIS indicating course work completed. If I wait till September for certificate it will be almost impossible to get H-1 in 65000 cap. Any suggestions??? Pls help. Thnx -Kitu

If you are sure to get the certificate in Aug, go and file H1 ordinary process now with out a degree certificate. You will be on the Q and inside the quota.

You will get your RFE around Aug 2005 with 60 days time to submit. By that time you can provide your degree certificate. So that you will not miss the quota.
