Can the student be on status if he files for H-1(ordinary processing) in April whose OPT expires one week before October 1st, 2004? Whats the case if he files for Premium processing?
Also the OPT started 40 days after graduation. Can the student use the balance 20 days as the buffer and still stay on status?

What happens to the H-1 petition if the student goes to school to maintain status from OPT to F-1?

+++++++++++++He/she will be in status because of the backend grace period (F-1 60 days; J-1 30 days). But they cannot work after OPT expiration, until October 1 and until H-1 approval is obtained.

Whats the case if he files for Premium processing?
