I am currently an F-1 student here in the states. My father filed for my permanent residence in 2003. He became a naturalized citizen in March 2006. I turned 21 in August 2005. I read somewhere in the child protection act that you can subtract the number of days that the petition was pending from the current age, and that would give you the true age. If my petition was pending for about 8 months before it was approved, could 8 months be deducted from my 21 and 7 month age at the time of his naturalization, therefore making me under 21, an immediate relative of a US Citizen?

Thanks alot for your assistance.

Ok there's still some details missing. Did he file an I-130 for you? Was it approved? Did he file an I-485 for you and what is the status on that?

He couldn't have filed I-485 since he was an LPR when he filed for his child in 2003. It takes 5+ years to get the priority date to be current in this case.

So, it was only I-130.
